The following is a summary of the eligibility requirements
for classification as a California resident under the Two Year Care and Control
provision. A minor student is entitled to resident classification if, immediately
prior to enrolling in a post-secondary institution, s/he has been living with
and been under the continuous direct care and control of an adult or adults other
than a parent(1) for a period of not less than two years. This classification
will continue until the student has attained the age of majority and has lived
in California the minimum time necessary to become a resident, so long as continuous
full-time enrollment is maintained at a post-secondary institution. The adult
or adults having control must have been residents of California during the one
year immediately prior to the residence determination date(2) of the term
for which classification as a resident is requested.
Requirements:
- The student must have lived with an adult, or series of adults, other than
a parent, for at least two years immediately prior to enrollment(3);
- During this two-year period, the student must have been under the continuous
direct care and control of these adults;
- During the one year immediately prior to the residence determination date,
the adult or adults must have been residents of California;
- A student who is not a U.S. citizen or permanent resident must be eligible
to establish residence once majority is reached;
- The student must be under age 18 at the time s/he enrolls; once enrolled,
the student must maintain full-time attendance at a post-secondary institution.
If the student has enrolled in more than one post-secondary institution,
her/his attendance in all post-secondary institutions must amount to
continuous and full-time throughout the prescribed period. If the student
qualified
for this exemption at a community college or campus of the California
State University, s/he will continue to be eligible upon transfer to the
University
of California, as long as the student maintained continuous attendance.
- The student must live with the person having care and control and at no
other address. No exceptions may be made to this requirement (e.g., private
school or community college).
NOTICE: The student is cautioned that this summation is not a complete
explanation of the laws regarding residence. Additional information is available
from the
Office of the Registrar. Changes may be made in the residence requirements
between the publication date of this statement and the relevant residence
determination

(1) The term "parent' refers
to the biological or adoptive parent(s), and does not include step-parent(s)
unless expressly noted.
(2) For all campuses except Berkeley: the day instruction begins at the last of
the University of California campuses to open for the term. For the Berkeley campus:
the day instruction begins at Berkeley.
(3) "Enrollment" refers to the date the student has actually signed up for classes,
or the date the student's fees are paid, whichever occurs first.
